TEXAS CHILD CUSTODY ISSUES

Although there are exceptions, it is the policy of Texas that both parents will remain involved in their children’s lives. However, the time that each parent will spend with their children as well as each parent’s rights to make decisions regarding their children need to be determined. For instance, one parent may have the right to determine the children’s primary residence while the other parent may not.

TEXAS CHILD SUPPORT AND VISITATION

In Texas both parents have the responsibility to support their children. The Texas Family Code outlines the child support guidelines, which are presumed to be in the best interest of the children.  An important aspect of child custody is child support, whether paid or received. Often times, the party paying the child support can be bitter or angry about having to pay child support because they believe that the money is going to the other party. Realistically, the party with whom the child resides is paying for the expenses of child as well.

MODIFICATION OF CUSTODY OR SUPPORT

In Texas, child custody and child support orders can be modified if there is a material and substantial change in circumstances after divorce or final order (if the parties were not married).
